The Appellate Division of the Hidalgo County Criminal District Attorney's Office is responsible for handling all post-trial appeals of criminal cases handled by other divisions of the office.
The Appellate Division of the Hidalgo County Criminal District Attorney’s Office is responsible for handling all post-trial appeals of criminal cases handled by other divisions of the office. This can include direct appeals of criminal cases, juvenile cases, protective order or civil commitment cases. It also includes petitions for discretionary review to the Texas Supreme Court and Court of Criminal Appeals as well as writs of certiorari to the United States Supreme Court. In addition, attorneys in the Appellate Division respond to requests for post-conviction DNA testing, as well as, post-conviction applications for writs of habeas corpus.
In addition to the appellate work, the Appellate Division also assists other divisions in the Criminal District Attorney’s Office as needed. This assistance can range from providing advice to trial attorneys on preserving specific points of appeal during trial to coordinating general legal training programs within the office. Indeed, the Appellate Division attorneys frequently attend hearings and arguments for serious felony trials, providing appellate support throughout.
