The Hidalgo County Intake and Grand Jury Division has the responsibility for processing, reviewing and making charging determinations for over 30,000 Hidalgo County criminal cases every year.
The Hidalgo County Intake and Grand Jury Division has the responsibility for processing, reviewing and making charging determinations for over 30,000 Hidalgo County criminal cases every year. The majority of these cases are submitted by over 25 different law enforcement agencies that have arrested individuals for criminal offenses ranging from Class ’B’ Misdemeanors to Capital Felony offenses.
Each case submitted is reviewed for legality and sufficiency by a staff member of the Intake and Grand Jury Division. A charging determination is made, and the appropriate charging document is prepared. following the procedures set out below:
A case may also be rejected also by the Intake division prior the filing with the Hidalgo County Courts at Law or the District Court. A rejection of a case from the Intake Division results in a dismissal of that charge.
In addition to the review of criminal cases, the Intake Division also performs other functions as assigned by the District Attorney. These include:
Law Enforcement Support. Assistant Criminal District Attorneys and District Attorney Investigators serve as advisors to law enforcement agencies by way of providing legal advice and support in ongoing criminal investigations. Some examples of this are the coordination and filing of grand jury subpoenas, search warrant preparation and review, and phone track and trace court orders.
Interstate and International Extraditions. Assistant Criminal District Attorneys work with law enforcement to make determinations on whether or not a particular case is viable for extradition. Assistant Criminal District Attorneys also prepare and file the appropriate documents and motions for international extradition with the federal authorities.
Review of Jailings/Fastrack Program Screening. In an attempt to alleviate jail overcrowding and expedite the processing of misdemeanor and non-violent felonies, the Intake Division continually performs a review of individuals who have been booked into the Hidalgo County Jail. These individual cases are screened for qualification for a personal bond recommendation or assignment to the Fastrack program.
